The Department of Energy General Counsel’s office grants patent waivers which determine the ownership of patents generated under DOE awards. DOE is required by law to make waiver determinations public. Patent waiver determinations are posted on the Department of Energy General Counsel website. In October 2009, the Office of General Counsel released guidance on ex parte communications (i.e., written, electronic, or oral communication that is not provided to all interested parties) during informal rulemaking proceedings. Memos memorializing ex parte communications must be emailed to expartecommunications@hq.doe.gov.
